California – At Berth Regulation

This Circular is issued to advise that the United States Environmental Protection Agency (US EPA) has granted approval to the California Air Resources Board (CARB) to enforce the 2020 At Berth Regulation in California.

During the transition period (from January 1, 2023, to November 19, 2023), vessel and terminal operators could choose between two options, but starting from November 20, 2023, they must comply with the provisions of the 2020 Regulations.

The 2020 Regulation can be found in sections 93130 through 93130.22 of Title 17, of the California Code of Regulations.

CARB has issued an Enforcement Notice , which gives links to various related websites, and reporting templates.

Compliance with the 2020 Regulation can be through any CARB Approved Emissions Control Strategy (CAECS) including use of shore power, one of the approved capture and control systems, or a future CARB-approved shore or vessel based solution, including alternative fuels. The attached FAQ document gives useful advice on the various methods of achieving compliance with the Regulation.

Ship Owners/ Managers/ Operators should ensure that they are prepared to comply with the requirements of the 2020 Regulation, have the latest version of the California Code of Regulations onboard, and make all necessary reports on
time and using the appropriate templates.
