MLC, 2006 and the 2014 amendments

Following five years from the entry into force of the Convention and since the 2014 amendments should be verified prior the first renewal MLC inspection, it is appreciated that most of ships should comply before August 20, 2018.

Further to our Circular C15008, amendments to the MLC, 2006 have been adopted by the International Labour Organization’s (ILO) Special Tripartite Committee on April 2014 and International Labour Conference on June 2014 for the financial security for repatriation (Regulation 2.5) and financial security relating to shipowners’ liability (Regulation 4.2).  By adopting these amendments, the areas covered by the Declaration of Maritime Labour Compliance (DMLC) Parts I and II become 16 instead of 14.

More specifically, the above-mentioned items shall be added to the Declaration of Maritime Labour Compliance (DMLC) Parts I and II and evidence of financial security under Regulation 2.5 for Repatriation and Regulation 4.2 for Ship-Owners Liability as per the new Appendices A2-1 and A4-I respectively of the Convention shall exist on board.

The verification of compliance with the 2014 amendments, of DMLC Parts I and II should be carried out no later from the date of first renewal inspection following the entry into force of the amendments on January 18, 2017.

Since the Convention has entered into force on August 20, 2013 it is appreciated that a significant number of vessels have entered the three months window for their renewal inspection which is due in August and/or until Autumn this year.

Example of completed DMLC Part II

The DMLC Parts I and II have two new items, the financial security for repatriation (Regulation 2.5) and financial security related to ship owners liability (Regulation 4.2).  Herewith below you may find an example of completed DMLC Part II with what information shall be provided for both two new regulations.

“15. Financial Security for Repatriation (Reg. 2.5)

Appropriate insurance is obtained and retained on board the vessel.

  1. Financial Security Related to Shipowners Liability (Reg. 4.2)

Appropriate insurance is obtained and retained on board the vessel.”

Ship Owners/ Managers/ Operators must contact the flag Administration to request re-issuance of the amended DMLC Part I.  In addition, Ship Owners/ Managers/ Operators must complete the revised DMLC Part II to outline actions taken to ensure compliance with the amendments.

The re-issued DMLC Parts I and II along with evidences of evidence of financial security under Regulation 2.5 for Repatriation and Regulation 4.2 for Ship-Owners Liability as per the new Appendices A2-1 and A4-I shall be submitted to DromonClass Head Office prior the schedule renewal inspection.

MLC Inspectors must ensure during upcoming renewal MLC inspections that both DMLC Parts I and II as well as evidences of financial securities exist on board (refer to AWP03/Form 09).
